Terms of Service

Welcome to Fucial Group Türkiye Ltd's website. By accessing or using our platform, you agree to comply with and be bound by the following Terms of Service (“Terms”). Please read them carefully before using our services.


1. Eligibility


You must be at least 18 years old and legally capable of entering into contracts under Turkish law to register as a service provider or client.


Service providers must successfully complete identity verification and background checks conducted through our accredited KYC partner, Persona.


2. Scope of Services


Fucial connects independent service providers (“Workers”) with clients (“Customers”) seeking handyman and related services.


Fucial does not directly provide handyman services; it serves as a platform for matching, payments, and quality assurance.


All services are performed under independent contractor status. Workers are not employees of Fucial.


3. Registration and Accounts


Users must register with accurate and complete information.


Email validation is compulsory during account setup.


Users are responsible for maintaining the confidentiality of their account credentials.


4. Payments


Payments from Customers are collected by Fucial on behalf of Workers.


Payments are processed in Turkish lira (TRY) through approved local payment channels.


Workers may customize disbursement schedules (daily, weekly, or monthly).


Same-day payment processing is provided where applicable.


5. Service Bookings and Cancellations


Service bookings depend on availability of Workers.


Bookings may be canceled by either party before commencement of work.


Frequent or abusive cancellations may result in account suspension.


6. Notifications


Customers and Workers may manage email notifications for bookings, payments, and updates.


Some notifications, such as account verification and regulatory notices, are mandatory and cannot be turned off.


7. Quality and Conduct


Workers must maintain professional standards and comply with all applicable laws.


Customers must provide accurate service details and ensure safe working conditions.


Harassment, fraud, or misuse of the platform will result in immediate suspension or termination.


8. Liability


Fucial acts solely as an intermediary and is not responsible for the quality, timeliness, or outcome of services performed by Workers.


Fucial’s liability is limited to amounts paid through the platform for disputed transactions, subject to the Refund Policy.


9. Compliance


All payments and transactions are subject to Turkish tax and financial regulations.


Users are responsible for reporting their income or expenses as required by law.


10. Termination


Fucial reserves the right to suspend or terminate accounts that violate these Terms.


Users may close their accounts at any time, provided all pending obligations are fulfilled.


11. Governing Law


These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be resolved by the competent courts of Istanbul, Turkey.


Fucial Refund Policy


Effective Date: January 15, 2025


At Fucial, customer satisfaction is a priority. This Refund Policy outlines the conditions under which Customers may receive a refund.


1. Eligibility for Refunds


Refunds are available only for services booked and paid for through the Fucial platform.


Refund requests must be submitted within 72 hours of the scheduled service time.


2. Refundable Cases


A Customer is eligible for a full or partial refund if:


The Worker fails to appear for the scheduled service.


The Worker cancels the booking after payment without an acceptable replacement.


The service is not completed as described and verified by Fucial’s support team.


3. Non-Refundable Cases


Refunds will not be granted if:


The Customer cancels the booking less than 12 hours before the scheduled time.


The service was completed to reasonable standards but did not meet subjective expectations.


The dispute arises from circumstances beyond Fucial’s control (e.g., weather, third-party delays).


4. Process


Customers must contact Fucial Support through the app or website to initiate a refund request.


Evidence (such as photos, communication logs, or receipts) may be required.


Fucial will review the claim within 5 business days and notify the Customer of the outcome.


5. Refund Method


Approved refunds will be remitted in Turkish lira (TRY) using the original payment method.


Processing time may vary depending on the bank or payment provider but generally takes 5–10 business days.


6. Worker Compensation Adjustments


If a refund is issued, corresponding payment adjustments will be made to the Worker’s account.


Workers who accumulate repeated refund-related complaints may be suspended or removed from the platform.
